IMPORTANT: Australian Hair Concierge provides booking coordination services and processes payments on behalf of overseas hair treatment providers. We are not a treatment provider. All clinical services are provided solely by your chosen overseas Provider. Our processing of payments does not create a treatment relationship between you and Australian Hair Concierge.
Welcome to MedTravel Pty Ltd ACN 686 275 267 of 526/368 Sussex St Sydney 2000, trading as Australian Hair Concierge. We provide a concierge service to introduce those seeking hair treatment to overseas hair treatment providers. You are then able to choose whether to engage a particular hair treatment provider (“Provider”) to provide the treatment you seek.
These Terms and Conditions (“Terms”) are designed to ensure you understand the terms and conditions under which we provide our concierge services (“Services”).
By using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, including any future modifications. If you do not agree to these Terms, you must cease using our Services immediately.
1. Core Values and Commitments
We are committed to providing quality Services and we will continue to strive to provide you with the concierge assistance and information that you seek.
1.1 Information Provided
Our Services will provide you with information given to us by the hair treatment provider and we will process payments on behalf of that Provider. Based on their information you can decide the particular treatment that you require and whether you wish for that provider to provide your hair treatment services.
1.2 Customer Confidentiality
Our commitment is to protect the personal information and purchase history of all our users.
1.3 Continuous Improvement
We are dedicated to continuously improving our Services through technological enhancements, addition of new hair treatment options, and feedback from our community.
1.4 Regular Updates
We recognise the vital importance of regular updates to our security measures and operational practices so we can provide you with the most helpful assistance possible.
2. Understanding Our Services
2.1 Other Service Providers
Our service aims to showcase a range of treatment options that can be purchased through Australian Hair Concierge and are serviced by an external hair treatment clinic. The chosen provider maintains its own business and manages their own treatment protocols, operational procedures and their own set of trading terms and conditions.
2.2 Relationship with Providers
While we intend to promptly act in relation to any issues that we become aware of, despite our best efforts, we bear no responsibility for the accuracy or completeness of the information a Provider has passed onto us or any changes they may decide to implement.
3. Understanding Service Limits
We will provide you with our Services with the clear understanding that you acknowledge and fully accept the service limitations and terms set out below.
3.1 Provider Policies
The hair treatment and related services are the sole responsibility of the Provider that you have chosen and we bear no responsibility for their actions or any changes that they may make to their policies or practices.
3.2 Service Limitations
Despite our best efforts, some information provided to us by the Provider may not be up to date, complete or accurate. While we process payments on behalf of Providers, any disputes regarding the quality of treatment or services rendered should be directed to the Provider. Our processing of payments does not make us liable for the Provider's services or create joint liability with the Provider.
3.3 Completion of Services
Once the patient arrives in Turkey and is greeted by EsteNove, the patient agrees that AHC’s services are considered complete and all responsibility and liability is now with EsteNove, our clinical partner.
4. User Risks
Your use of our Service is at your own risk. You acknowledge and fully accept that:
- We have no direct control over the information, policies, practices, or procedures delivered by the Provider.
- Any engagement that you decide to enter into is strictly a matter between you and the Provider.
- The Provider is solely responsible for honoring any undertaking, contract, or assurance that they have given;
- We are not responsible for changes made by Providers to any discount, booking, or timeframe offered by a Provider or changes to any particular offer or booking or the discontinuation of any offer.
- While we process payments for treatment services on behalf of the Provider, this payment arrangement does not make us responsible for the treatment services or create an agency relationship between us and the Provider. The Provider remains solely responsible for all clinical aspects of your treatment.
4.1 No Warranty
We make no representation or warranty (either express or implied) as to the completeness or accuracy of the information that a Provider has provided to us.
4.2 Service Use
For the avoidance of doubt these Terms apply unless otherwise agreed or amended by account-specific terms.
5. Service Guarantees
Our Services come with guarantees under the Australian Consumer Law that:
- they will be provided with due care and skill;
- they will be reasonably fit for the specified purpose;
- they can reasonably be expected to achieve the desired result; and
- they will be provided within a reasonable time.
If we fail to meet any of these guarantees, you have rights under the Australian Consumer Law.
6. No Results Guarantee
Australian Hair Concierge do not guarantee hair treatment results and clients are not eligible for refunds based on dissatisfied or displeasing outcomes. Clients understand that whilst all measures are taken to refer to a suitable clinic for their procedure, treatment results may vary. Advertised hair treatment results presented are only a representation and do not provide a guarantee of future results. We do not guarantee website offerings will meet customer expectations.
7. User Responsibilities
You must be at least 18 years of age and possess the legal capacity to agree to these Terms and to use our Services.
7.1 Information Accuracy
If you provide any information that is untrue, inaccurate, not current, or incomplete, or if we have reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, we may suspend or terminate your account.
8. Payment
8.1 Prices
All prices are subject to availability and can be withdrawn or varied without notice. Prices are only guaranteed once your booking has been paid for in full. Please note that prices quoted are subject to change and are quoted in AUD.
8.2 Financial Arrangements
We process payments for treatments provided by overseas Providers and may receive remuneration through commissions, financial incentives, fees or payments, rebates, and other means (together, "financial arrangements") from those Providers. We are entitled to retain, and we are not required to account to you, for any such fees, payments or credits we may receive beyond what is outlined in your specific booking details.
8.3 Deposit and Final Payment
You will be required to pay a deposit or deposits when booking our Services. We will advise you of how much that will be. Subject to your rights under the Australian Consumer Law, all payments are non-refundable for changes of mind or cancellations by you.
Our change and cancellation fees reflect the reasonable, direct and indirect costs, time and effort incurred or involved in us providing booking and advisory services to you, as well as processing and managing the changes to, or cancellation of, your booking.
8.4 Change or Cancellation by You
If you change any aspect of your booking, we will do our best to accommodate your request, but it may not always be possible.
If you cancel any aspect of your booking, you will forfeit all payments made.
8.5 Unavoidable or Extraordinary Circumstances
In the event of unavoidable or extraordinary circumstances, we may materially modify or cancel the Services we provide to you as set out below. In these Terms, “unavoidable or extraordinary circumstances” means any cause outside our reasonable control which could not have been prevented or avoided even if all reasonable measures had been taken by us (including, but not limited to, war, threat of war, riot, civil disturbances, industrial dispute, terrorist activity and its consequences, plague, epidemic, pandemic, infectious disease outbreak or any other public health crisis (including quarantine or other employee restrictions), natural or other disaster (such as volcanic ash or hurricanes or similar events), nuclear incident, fire or bushfires, adverse weather conditions (actual or threatened, including snow and fog), unavoidable technical problems with transport, unforeseen alterations to transport schedules, illness or emergency event of key personnel or staff, transportation disruptions or cancellations, domestic and/or international travel restrictions, changes to travel advisories and restrictions, changes to health advisories and quarantines, changes to immigration, labour, rescheduling of aircraft or boats or other modes of transport, changes to applicable laws and/or other government mandates (including evacuation orders and border closures), and similar events).
8.6 Appointment Disruptions
Australian Hair Concierge is not responsible to accommodate date changes due to flight disruptions, visa issues, protests, war or any other matter of disruption.
We strongly recommend that travel insurance is separately sought out for all customers to account for unforeseen circumstances, delays or travel restrictions.
8.7 Payments by Credit Card, Debit Card and Cash
You authorise us to charge all fees for services incurred by you in relation to the products and/or services provided by us to the credit card or debit card designated by you. If payment is not received from the card issuer or its agents for any reason, you agree to pay us all amounts due immediately on demand.
We will save your credit card details on file, they will be securely stored and may be used for your future transactions with us (including transactions agreed over the phone or by email). You can choose to remove your saved credit card details at any time by contacting us.
8.8 Payment Processing for Overseas Providers
We process payments on behalf of overseas Providers as part of our concierge services. When you make payment to us for treatment services:
- Your payment to us for treatment services represents our collection of funds on the Provider's behalf;
- We will forward the relevant portion of your payment to the Provider according to our agreement with them;
- This payment arrangement does not create any agency, partnership or joint venture relationship between us and the Provider;
- The Provider remains solely responsible for all aspects of treatment provision and quality; and
This payment structure does not alter the limitations of liability outlined in these Terms.
7.8 Payment Process
To secure a treatment date a minimum $500 AUD deposit is required and these funds are transferred to the overseas provider to confirm placement. . Payment options are available to allow clients to pay the package balance monthly by means of direct debit from credit card. As per our communication on payment details acceptance through paid deposits authorises us to debit their card according to the communicated schedule.Full payment must be received no later than 30 days from treatment date.
Defaulting on the payment plan or failing to pay 30 days in advance will result in cancellation of the treatment and forfeit of funds.
7.9 Our cancellation / reschedule terms are:
Clients are able to reschedule the treatment date prior to forty five days from treatment date. If clients wish to cancel or reschedule the services within the forty five day period prior to treatment we do not guarantee we are able to reschedule with the treatment provider and as a result any funds paid for services would be non refundable. If a client cancels at any time without the intention of rescheduling then any funds paid are non refundable.
9. Provider Relationships
9.1 Provider Terms
Each third party service provider maintains its own terms and conditions for their business operations. Your use of these individual operations programs is subject to both our Terms and the terms of the relevant business.
9.2 Independence of Provider
Hair treatment providers and other third party service providers are independent entities and are not our agents, partners, or employees, despite our processing of payments on their behalf. We are not responsible for the quality of products, services, or customer service that they provide. Our role in processing payments for the Provider does not create any treatment or clinical relationship between you and us.
10. Data Collection, Use, and Sharing
We collect and process personal data in accordance with the Australian Privacy Act 1988 (Cth) and the APPs. This information that you directly provide to us may include details such as your name, email address, as well as information about your use of our Services.
10.1 How We Use Your Information
Your information is used to qualify, provide, maintain, and improve our services, to communicate with you about available offers, and to comply with our legal and regulatory obligations.
10.2 Sharing Your Information
Your personal information may be shared with a Provider or other third party service provider that is directly related to the Services that you have requested that we provide. We will not share your personal information with third parties for marketing purposes without your explicit consent.
11. Intellectual Property
Our informational material and its original content and features are and will remain our exclusive property. Our content is protected by copyright and other laws in both Australia and foreign countries.
11.1 Third Party Branding
The names, logos, and branding of a Provider is their intellectual property and are used by us with their permission. You may not use, reproduce, or distribute the branding of any third party Service providers without their explicit permission.
12. Modifications to Terms and Services
We reserve the right to modify or replace these Terms at any time at our sole discretion.
12.1 Amendments
The revised Terms will be immediately effective once they are posted and we will provide notice of such changes by posting the revised Terms and/or notifying our users via email. If you continue to use our Services after you have been notified of those changes, you will be deemed to have consented to abide by those changes.
12.2 Service Changes
We also reserve the right to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. We will not be liable to you or to any third party for any modification, suspension, or discontinuance of the service.
12.3 External Changes
Third party service providers may join or discontinue working with us. We will make reasonable efforts to notify users of any changes, but cannot guarantee advance notice in all cases.
12.4 Third Party Service Modifications
We rely on third party businesses to provide us with accurate and updated information about the services they provide. If any business modifies their services or terms we will make reasonable efforts to update the information we provide. While we strive to keep abreast of any changes, we are not responsible for any inconvenience or loss resulting from such modifications.
12.5 Notification of Changes
We will make reasonable efforts to notify users of significant changes to relevant third party services terms. However, it remains your responsibility to stay informed about the terms and to make your own enquiries.
13. Promotional Offers
13.1 Special Promotions
From time to time, we may offer special promotions and these promotions are subject to their own terms and conditions, which will be displayed at the time of the offer.
13.2 Eligibility
Eligibility for promotions may be based on location, purchase history, account status, or other factors. Not all users will be eligible for all promotions.
13.3 Promotion Limitations
Promotions may have limitations such as time restrictions and these limitations will be clearly communicated as part of the promotion details.
14. Termination
We may terminate or suspend or bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
14.1 Survival
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
15. Dispute Resolution
15.1 Issue Reporting
If there is an issue that you are concerned about, you should first attempt to resolve the issue through our customer support. Where possible, we will work with you to promptly address your concerns.
15.2 Treatment Complaints
Any complaints about the quality of any treatment you have received should be addressed directly with the Provider. While we may facilitate communication in some cases, we are not responsible for resolving such complaints.
We do appreciate it if you let the Australian Hair Concierge support team know of a provider quality issue if experienced. Whilst separate to the concierge service we provide it does help Australian Hair Concierge continually monitor that the providers we collaborate with continue to maintain a professional standard.
16. Disclaimers and Limitations of Liability
Our Services are provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
16.1 Limitation of Liability
In no event shall we, nor our directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or other intangible losses, resulting from:
(i) your access to or use of or inability to access or use a service;
(ii) any conduct or content of any hair treatment provider or other third party;
(iii) any unauthorised access, use, or alteration of your account or content.
16.2 Accuracy and Integrity of Information
Although we attempt to ensure the integrity and accuracy of any information we provide, it makes no representations, warranties, or guarantees whatsoever as to the correctness or accuracy of the information or any related content.
16.3 Inaccuracies or Errors
It is possible that the information we provide could include typographical errors, inaccuracies, or other errors and that unauthorised additions, deletions, and alterations could be made to that information by third parties. In the event that an inaccuracy arises, please inform us so it can be corrected.
16.4 Corrections
We reserve the right to unilaterally correct any inaccuracies on the information we provide without notice and we will have no responsibility or liability for information or content provided by any non-affiliated third party.
16.5 Penalty for Incorrect Information
If information provided to Australian Hair Concierge is incorrect or misleading, specifically related to procedural qualifying questions; Australian Hair Concierge then reserves the right to charge the patient a surcharge up to the sum of $2,000 AUD for additional fees incurred by overseas treatment providers.
17. Governing Law
These Terms shall be governed and construed in accordance with the laws of New South Wales Australia, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
